South Korea’s own Justice Minister is publicly voicing anxiety over his own government’s signature prosecutorial reform, just weeks before it takes effect. A clip of Jung Sung-ho, caught in an unguarded moment, saying “what comes next is the real problem, I’m genuinely worried,” has been circulating and drawing renewed attention. It echoes concerns he raised earlier this month, when he said that if the criminal justice system does not match reality once prosecutorial investigative authority is abolished, corrections need to happen quickly, and that the system exists above all to protect the public’s lives, property and safety.
At issue is a Criminal Procedure Act amendment that passed the National Assembly on July 31 under Democratic Party leadership, which completely eliminates prosecutors’ investigative authority. The change takes effect October 2, alongside a broader reorganization of the prosecution service’s investigative divisions. Once it takes effect, all frontline investigation shifts to the police, with prosecutors limited to legal review and indictment decisions. Minister Jung has said the prosecution needs to carefully work out implementing ordinances and investigative guidelines covering how it will offer police legal judgment and consultative support, and that requesting a Constitutional Court ruling on the division of authority would not be appropriate for the Ministry of Justice to pursue, even as he stated he has not recommended that President Lee veto the bill.
What makes this worth watching is where the doubt is coming from. This is not opposition criticism from the outside. It is the minister at the head of the ministry directly overseeing implementation, someone within the ruling camp, openly signaling concern before the law even takes effect. When a cabinet member says out loud that the fallout down the road is the real problem and that he is genuinely worried, in a system where investigative authority is being reshuffled under a compressed timeline set by legislative force, that is a warning meant for the public that this reform carries real risk to how effectively crimes get investigated.
If, come October, investigative gaps or coordination failures between police and prosecutors leave victims inadequately protected, in exactly the way the minister himself worried about, the burden of that outcome falls on ordinary citizens, not on the political calculations of whichever side pushed the bill through. The Democratic Party needs to treat its own Justice Minister’s warning as more than background noise, and build in a specific safety net, and a fallback plan, before the system actually launches. Steamrolling ahead based on legislative numbers alone, without addressing the doubts raised by someone charged with implementing the law, is not reform. It is a gamble with public safety as the stake.

이번 사안의 배경은 지난 7월 31일 더불어민주당 주도로 국회를 통과한 형사소송법 개정안이다. 검사의 수사권을 전면 폐지하는 이 법은 검찰 수사 조직 개편과 맞물려 오는 10월 2일 시행된다. 법이 시행되면 일선 수사는 모두 경찰이 맡고, 검찰은 법률 판단과 기소 여부 결정에만 관여하게 된다. 정성호 장관은 경찰에 법률 판단과 자문 지원을 어떻게 제공할지 검찰이 시행령과 수사준칙을 촘촘히 다듬어야 한다고 말했고, 권한 분배를 둘러싼 헌법재판소 권한쟁의심판 청구는 법무부가 나설 사안이 아니라고 선을 그었다. 다만 이재명 대통령에게 거부권을 건의하지는 않았다고도 밝혔다.
왜 이 우려가 가볍지 않은가
이번 발언이 주목받는 이유는 우려의 출처에 있다. 이것은 외부 야당의 비판이 아니라, 시행을 직접 책임지는 부처의 수장, 그것도 여권 내부 인사가 법 시행 전부터 공개적으로 우려를 드러낸 경우다. 입법 강행으로 압축된 일정 속에서 수사권 체계가 재편되는 와중에, 국무위원 스스로 뒷감당이 진짜 문제라며 걱정된다고 말했다는 것은 이 개혁이 실제 범죄 수사 효율성에 상당한 리스크를 안고 있다는 경고로 받아들여야 한다.
시행 이후 부작용, 그 부담은 누가 지나
10월 이후 경찰과 검찰 사이 수사 공백이나 조율 실패로 정성호 장관이 스스로 우려했던 대로 피해자 보호에 구멍이 생긴다면, 그 결과의 부담은 법안을 밀어붙인 어느 정치 진영의 계산이 아니라 평범한 국민에게 고스란히 돌아간다. 민주당은 자당 소속 법무부 장관의 경고를 배경음으로 흘려듣지 말고, 실제 제도가 가동되기 전에 구체적인 안전망과 대안을 마련해야 한다. 법을 집행할 당사자가 던진 우려조차 풀지 않은 채 입법 숫자만 믿고 밀어붙이는 것은 개혁이 아니라 국민 안전을 담보로 한 도박이다.
