A sitting U.S. senator has publicly labeled South Korea “ungrateful” and called for a formal Section 301 trade investigation, over Seoul’s regulatory campaign against American companies. Senator Bernie Moreno of Ohio sent a letter to the Office of the U.S. Trade Representative demanding an investigation, including potential Section 301 tariffs, into what he described as South Korea’s aggressive regulatory actions against American businesses such as Coupang.
At the center of the dispute is Coupang, a U.S. e-commerce company. After a data breach affecting millions of users, Moreno argues, Korean regulators used the incident as a pretext to weaponize government power against the very American companies helping drive Korea’s digital economy. Major U.S. investors in Coupang had already filed a Section 301 petition with the USTR over the matter, but withdrew it after discussions with U.S. trade officials suggested Washington might pursue a broader investigation into Korea’s trade practices toward American firms — a sign the case had moved from a private grievance to the level of formal U.S. government policy concern. Moreno’s letter went further, invoking the decades of American security and economic support that helped rebuild South Korea after war, and warning that Seoul cannot keep exploiting American goodwill while turning regulators against American innovators.
What this reveals is that a domestic regulatory action, whatever its stated justification, is being read in Washington as a symbol of Korea’s broader posture toward the alliance. Precisely because this involves an American company operating in Korea, not a purely domestic matter, this is a case where diplomatic and economic channels need to work together from the outset, rather than treating it as an issue for the relevant ministry alone. Given that Section 301 authority allows the U.S. government to move straight to tariffs and countermeasures once an investigation concludes, this could escalate well beyond a bilateral irritant into a matter affecting the overall Korea-U.S. trade relationship.
Moreno’s letter specifically asked the USTR to launch a formal investigation under available legal authorities, pursue consultations under existing trade agreements, and prepare proportionate countermeasures to restore fair treatment for American companies. If the Lee Jae-myung government keeps treating a regulatory posture already read on Capitol Hill as a symbol of anti-American sentiment as merely an internal Korean matter, the fallout will not stop with Coupang, and it will not stop with trade either. Korea needs to grasp, without delay, that the alliance’s foundation of trust is not an inexhaustible resource.

국내 규제 하나가 왜 동맹 신뢰 문제로 번지나
이번 사안이 보여주는 것은 명분이 무엇이든 한국의 국내 규제 조치 하나가 워싱턴에서는 한미동맹을 대하는 한국의 전반적 태도를 상징하는 신호로 읽히고 있다는 사실이다. 이 문제가 순수한 국내 사안이 아니라 한국에서 활동하는 미국 기업이 얽혀 있는 사안인 만큼, 소관 부처 하나에만 맡길 게 아니라 처음부터 외교와 통상 채널이 함께 움직여야 하는 사안이다. 무역법 301조는 조사가 마무리되면 미국 정부가 곧바로 관세와 보복 조치로 넘어갈 수 있는 권한을 부여한다는 점에서, 이번 갈등이 양자 간 불편한 마찰 수준을 넘어 한미 통상관계 전반에 영향을 미칠 수 있다는 우려가 나온다.
모레노 의원은 서한에서 무역대표부가 가용한 법적 권한을 활용해 공식 조사에 나서고, 기존 통상협정에 따른 협의를 진행하며, 미국 기업에 대한 공정한 대우를 회복하기 위한 비례적 대응조치를 준비해야 한다고 구체적으로 요구했다. 이재명 정권이 이미 미국 의회에서 반미 정서의 상징으로 읽히고 있는 규제 기조를 여전히 국내 사안으로만 다룬다면, 그 후폭풍은 쿠팡 하나에 그치지 않을 것이고 통상 분야에만 머물지도 않을 것이다. 동맹의 신뢰라는 자산이 무한정 쓸 수 있는 자원이 아니라는 사실을 지금이라도 분명히 인식해야 한다.
